Shri CCBAU Trust land dispute: Court directs contesting parties to maintain status quo

Srinagar: A Local Court in Srinagar has issued directions to the contesting parties to maintain status quo with regard to the Shri Chaner Chinar Bada Akhara Udasin Trust at Kothi Bagh, Residency Road.
The Trust represented by Advocate Murfad Naseem stated that the Trust is registered before the competent authority and has every right to seek protection, enforcement and redressal of the legal, lawful, legitimate, and fundamental and constitution rights available under the Constitution of Indian.
It was further stated by the counsel that Abdul Gaffar Mir and Ghulam Ahmad Mir had obtained a patch of land for construction of a shop in the ground floor and room in the first floor at Real Chowk (hereinafter referred to as suit property). At present the defendants are running their business under the name and Style M/S Hollywood Bakery, M/S Blue Ribbon Bakery, M/S Hollywood Stores and Firdous Dry Fruits.
The counsel further stated that defendants had illegally occupied the Trust Property without any valid deed which manifestly made it clear that the defendants are holding the possession as trespassers.
He said that recently the defendants started reconstruction/repairs of the suit property and has refused to hand over the actual physical possession of the suit premises to the Trust as they are holding the same by way of illegal means.
After considering the arguments of the learned counsel for the trust namely advocate Murfad Naseem the court after giving thoughtful consideration to all what was stated by the counsel issued notice to the other side for appearance and for filing objections. Meanwhile subject to objections from other side and till objections are considered by the court, parties to the suit were directed to maintain status quo with respect to the suit property.
