SC frames committee to look into issues on 4G restoration in JK
Srinagar, May 11: The Supreme Court on Monday transferred the issue of examining the legality of restrictions to a committee comprising of Secretary Home Affairs, Secretary Communication and Chief Secretary, with Secretary of Home Affairs presiding the Committee.
The three judge Supreme Court bench led by Justice NV Ramana ordered for a special committee be set up while passing direction with regard to a petition seeking restoration of 4G services by Private schools association of Kashmir.
Justice Ramana while passing the directions said that “This court has to ensure national security and human rights are balanced. We do recognize that UT has plunged into crisis. At the same time court is cognizant to the concerns related to ongoing pandemic and hardships,” he added.
He said that in Anuradha Basin case we had said there should be adequate procedural safeguards. Thus, we hereby order to form a special committee which shall examine the contentions made by petitioners & it’s appropriateness & seek alternative remedy.
The SC further said that J&K court remarked the order on restricting bandwidth services in the UT was not done taking into consideration district-wise threat perception. The committee has to take into account district wise situation and then take a call on lifting the restricting or continuing curbs.
