Court quashes detention of 50 year old man under PSA

Srinagar: State High Court Monday quashed the detention of a 50 year old man under Public Safety Act (PSA).
Mushtaq Ahmed Wani son of Ghulam Nabi Wani, a resident of Kurag area of Central Kashmir’s Ganderbal was arrested by police station Kherbhawani on 7 August, 2019 on charges of ‘instigating’ youth for unlawful activities.
Subsequently, he was booked under PSA vide order number DMG/PSA/2019 and shifted to a jail in Agra, Uttar Pradesh on 9 August, 2019.
Advocate Bashir Ahmed Tak, who represented the accused said that the grounds given by police for his detention were that: “he was instigating youth for unlawful activities.”
Tak argued in the court of law that police booked Mushtaq Ahmed under PSA without lodging any FIR against him and further he was not provided the detention copy. He said Mushtaq was implicated in old cases for which court had already set him free.
The court of Justice Ali Muhammad Magray lashed out at police and district administration for booking Mushtaq Ahmed on flimsy grounds. Justice Ali Muhammad Magray observed that the accused is an elderly person against whom police have failed to prove any charges. After quashing his detention under PSA, he directed authorities to release the accused without any delay.
The State was represented by Advocate Asifa Padroo. Pertinently, the accused is currently lodged at Agra Jail in Uttar Pradesh. (KNT)
